SALFORD IMAGE LIBRARY - terms and conditions of use

By using this site and downloading images, you agree to be bound by this Agreement. If you do not accept this Agreement, do not request or download any images.

In this Agreement:

(a) 'Image' includes all digital images and any related textual information, including captions and credits

(b) 'Reproduction' includes any form of publication or copying of the whole or part of any image and whether or not altered whether by printing, photography, slide projection (whether or not to an audience) xerography, layout or presentation, electronic or mechanical reproduction or storage by any other means.

(c) 'The Supplier' means Salford City Council

(d) 'The Client' includes any person or organisation requesting images from the Supplier

1. The terms and conditions set out herein shall not be varied without the written agreement of the Supplier.

2. The Supplier grants to the Client a non-exclusive non-transferable licence to use the images in accordance with this Agreement.

3. The Client is permitted to use an image only once. If the Client wishes to use the image again, further permission must be obtained in writing from the Supplier.

4. The Client shall not unless expressly agreed with the Supplier, make any alterations, additions or modifications to an image.

5. The Client shall not copy or reproduce an image without the express consent of the Supplier.

6. The Client shall not give, sell, rent or hire an image in whole or in part, to any third party without the written consent of the Supplier.

7. The Client shall ensure that every use of the image is accompanied by an acknowledgement in the following form: 'By kind permission of Salford City Council' followed, where the name of the photographer is known, by ' © (name of photographer)'.

8. Within 21 days of using an image, the Client shall provide to the Supplier by post or electronic mail, a reference copy together with either a rate card if applicable, or details of the publication's advertising rates.

9. The Supplier makes no representations or warranties that it owns the copyright or trademark in any images. The Client shall at his/her own expense obtain from the copyright owner or owners written permission to include any part of an image.

10. The Client shall not use any image for any unlawful or pornographic purpose.

11. The Client undertakes fully to indemnify the Supplier at all times against all actions, proceedings, claims (including proper and reasonable legal and other fees) howsoever arising from:

    • infringement of any intellectual property rights in any part of the world as a result of the supply of images to and/or use of the images by Clients;
    • an action for defamation or other contravention of English law.

    In the event of any claim being made against the Supplier to which this clause applies, the Supplier shall promptly notify the Client in writing of any alleged infringement or other claim of which it has notice; and shall allow the Client to conduct any negotiations or litigation and settle any claim and give it all reasonable assistance to do so.

12. This agreement shall be subject to and construed according to English law, and the parties agree to accept the exclusive jurisdiction of the courts of England.
